These Terms of Service ("Terms") govern your use of the Cyber Aware platform, websites and services operated by Cyber Aware Pty Ltd (ABN 12 345 678 901). By accessing the service, you agree to these Terms.
1. The service
Cyber Aware provides a white-labeled human risk management platform for MSPs and their end clients. The service includes awareness training, phishing simulations, gap assessments, reporting and related features described on our marketing pages.
2. Subscription and fees
Cyber Aware is provided on a monthly subscription. Fees are charged per active seat, billed monthly in advance, with no minimum seat count - you only pay for the seats used across your client tenants. Plans are month-to-month with no minimum term unless otherwise agreed in a separate order form.
Fair-use applies: see our Fair Use Policy. We do not anticipate any customer being affected by fair use in normal operation.
3. Customer data and ownership
You retain ownership of all data you (or your end clients) upload to the service. We act as a data processor for customer-controlled data. We use data only to operate the service, improve it (with anonymised aggregate signals) and meet our legal obligations.
4. Acceptable use
You agree not to use the service to send unsolicited communications, attempt to compromise other tenants, reverse-engineer the platform, or violate any applicable law. Phishing simulations must only be conducted on email accounts you control or for which you have explicit consent.
5. Availability and SLA
We target 99.9% monthly uptime on the standard plan and 99.95% on Enterprise. SLA credits are detailed in our SLA addendum and apply where uptime falls below target in a calendar month.
6. Termination
Either party may terminate the agreement on 30 days written notice. We delete customer data within 30 days of termination unless retention is required by law.
7. Liability
To the maximum extent permitted by law, the total liability of either party arising out of or related to this agreement will not exceed the fees paid in the preceding 12 months.
8. Changes
We may amend these Terms with 30 days notice for material changes. Continued use after the effective date constitutes acceptance.
9. Governing law
These Terms are governed by the laws of Victoria, Australia. Any disputes are submitted to the exclusive jurisdiction of the courts of Victoria.
